기업간 소송과 분쟁이 심화되고 e-Discovery에 대한 법적 요구가 강해지면서 기업들은 전자 증거 수집의 중요성을 새롭게 인식하여 기존의 변호사 고용을 통한 소극적 대응 대신 기업의 전자 증거를 수집하고 분석할 수 있는 전자 문서 분석 솔루션들을 앞다투어 도입하고 있는 추세이다. 또한, 기업들은 소송 패소로 인한 기업 이미지 실추 등에 대해 대외적 투명성을 강화해야 한다는 필요성을 느끼게 되었으며, 이는 기업 컴플라이언스라는 새로운 시장 창출 효과를 가져왔다. 이렇게 e-Discovery는 2006년 그 개념이 등장한 이후 최근에는 기업 컴플라이언스 등과 맞물리면서 지속적으로 이슈화되고 있으며, 중요성은 점점 더 커질 것으로 예상된다. 향후 한미FTA 등 글로벌화가 확산될 경우 국내 다른 기업들도 이에 대해 무관심으로 일관할 수는 없을 것이다. 이에 본 고에서는 e-Discovery의 이해를 돕고, 향후 국내 민사소송법 개정 시 참고될 수 있도록 미연방민사소송규칙(FRCP)의 e-Discovery 관련 내용들을 고찰하였다.
